Court remands 3 men over alleged murder, arson attempt

An Ilaro Chief Magistrate Court, Ogun State, today, ordered the remand of three men, at the Ilaro center of the Nigerian Correctional Services (NCoS) for the period of 60 days, over alleged conspiracy, attempt murder, arson and conduct likely to cause public breach.

The three men ordered to be remanded are: Omolade Tajudeen; Musa Alubo and Adeyanju Sulaiman.

Magistrate D. O kolawole Ogunbowale (Mrs), made the remand order, after hearing Barrister Morufu Animashaun, of Force Criminal Investigation Department (ForceCID) Annex Alagbon-Ikoyi, Lagos, who moved an Exparte motion for the order.

Animashaun informed the court that the application for the suspects’ remand was pursuant to Section 36(7) Of The Constitution Of Federal Republic Of Nigeria 1999 (As Amended), Section 306 Of The Administration Of Criminal Justice Law Of Ogun State 2017, and under the court’s inherent jurisdiction.

Animashaun told the court that the one defendants, have been investigated and found culpable of the offences of Conspiracy to commit Felonies, attempted murder, Arson, malicious damage to property and conduct likely to cause a breach of the Peace.

He told the court that the three men allegedly committed the above listed offences on September 11 and 12, 2022, when they attempted killing one Otunba Akeem Adigun, the petitioner, and his sibling, while returning back from their maternal family meeting, at Isalegbodo Quarters, Agosasa, Ipokia Local Government Area of Ogun State, over leadership tussle of placing candidate on the vacant traditional stool of Agosasa.

He told the court that the order sought for is to remand the suspects pending when the enable the Director of Public Prosecution (DPP) to issue legal advice on the proposed charges against them.

Magistrate Ogunbowale, after hearing Animashaun, said: “I have listened to the submission of the counsel to the applicant. I have also take a cursory look at the motion Exparte, with affidavit in support, written address and the charges. The application deserves to be granted and same is hereby granted.

The three defendants are hereby ordered to be remanded in Oba or Ilaro center of the Nigerian Correctional Services, for the next 60 days, pending the issuance of legal advice by the director of public prosecution.

Meanwhile, the police have filed a 13 count-charge of Conspiracy, attempted murder, arson, willfully damage and conduct likely to cause public breach, against the three men, in the charge marked MLO/2M/2022,

The offences according to the prosecutor, Animashaun, are contrary to and punishable under Sections 516, 320 (2), 451, 355 and249(d) of the Criminal Code Law of Ogun State, Revised Laws of Ogun State, 2006.
